  • Payment must be effected by 16h00 by electronic funds transfer (EFT) on the day of the auction. No goods will be released without payment reflecting in our bank account. Cash payments into our bank account levy a 2% administration fee.
  • Fica documents as well as proof of deposit will be required upon registration.
  • The auction is conducted in terms of Section 45 of the Consumer Protection Act, Act 68 of 2008. The Buyer acknowledges that they have inspected the lots before bidding, noted the condition and state thereof, and is satisfied with the lots as well as the description thereof. All items on auction are sold with no duty to repair.
  • The purchaser is responsible for removal of all items and we will not be able to assist with loading of any goods. There will be no dispatching during the auction. Storage will be charged on late collections.

  • Buyers are advised to obtain a sales catalogue and familiarise themselves with the terms and conditions. To avoid misunderstandings, pay careful attention to the description of the item you are interested in.
  • Items must be inspected carefully before bids are made.
  • If you intend biding on an item during the auction, you need to register online. You will then be given a number which allows you to take part in the auction
  • A registration fee is payable via EFT to take part in the auction.
  • All deposits are refundable if the buyer is unsuccessful.


  • If your bid is successful you will receive a success email from An invoice will be then emailed stating the amount due.
  • This is subject to your bid not being Subject to Confirmation (STC) –in which case the seller needs to confirm or reject the price.
  • STC means your bid has a restriction and the seller needs to confirm your achieved price first. Once this has been confirmed, you can pay for your item.
  • If there was a STC on the asset, Powells Auctions will contact the buyer, once approval is received from the bank. Powells Auctions goes out of their way to complete this process as soon as possible.
  • A documentation fee is payable upon the execution of a successful bid.

  1. A buyer making the highest accepted bid for a lot shall become the purchaser immediately such lot has been knocked down to him.
  2. Should there be any dispute whatsoever over, or in respect of, any lot the auctioneer shall be entitled to settle such dispute at his sole discretion which shall include, but not be limited to, the absolute discretion to re-sell such lot or declare any bidder, the purchaser or re-open the bidding even after the drop of the hammer and even if this has the effect of setting aside a validly concluded first sale.
  3. *No party shall have a claim for damages of any nature in the event of the auctioneer settling any dispute. The auctioneer’s decision is final and binding on all the buyers.
  4. The auctioneer is not liable in any way for any errors or inaccuracies in the description or identification of goods. All goods are sold “voetstoots”. In making a bid, a bidder shall be deemed to have made him fully acquainted with the goods in the lot for which he bids.
  5. All accounts must be paid via EFT, forthwith, upon invoice, in default of which, the unpaid-for lots may at the auctioneer’s sole discretion be re-sold and the defaulter shall be liable for any shortfall. Ownership of the goods sold vests in the auctioneer’s principal until payment in full has been made. All goods are sold exclusive of VAT.
  6. The auctioneer’s roll of sale is final and binding on all buyers.
  7. The auctioneer reserves the right to regulate the bidding, to refuse any bid, to withdraw any lot from the sale and to stipulate any reserve price or conditions of confirmation of the bid as imposed by his principal.
  8. The risk in any goods sold, shall pass to the purchaser immediately such goods have been knocked down to the purchaser.
  9. The purchaser acknowledges that the auctioneer is not liable in any way for any damage to, or shortfall in, the goods or any goods stolen or destroyed before the purchaser takes delivery of the purchased goods.
  10. The purchaser shall remove the purchased goods at his sole risk and cost and shall be liable to pay storage costs to the auctioneer, if the goods are not removed as agreed
  11. Should legal proceedings be instituted, the auctioneer may in his sole discretion do so, in his own name.
  12. Should the purchaser not comply with any of these conditions, the auctioneer shall in addition to any other damages, be entitled to recover from such purchaser, any loss arising from the re-sale of any goods, together with the charges and expenses in respect of both sales and any deposit held by the auctioneer, shall be forfeited as “roukoop.” The signatory below shall be deemed to have bound himself to the auctioneer as surety and co-principal debtor waiving the benefits of exclusion and division in solidium with the purchaser, for the due performance of all the purchaser’s obligations in terms hereof.
  13. The purchaser hereby agrees to pay costs on the scale as between attorney and client in the event of any litigation and consents to the jurisdiction of the Magistrate’s Court, in terms of Section 45 of Act 32 of 1944, as amended but acknowledges that it is in the sole discretion of the auctioneer to institute action in the High Court.
  14. Every purchaser shall be deemed to act as principal unless the auctioneer has confirmed to him in writing prior to the auction, that he is aware that the purchaser acts as an agent for another named person. The provisions of Clause 10 above shall continue to apply to anyone signing these terms as an agent for another.
  15. The purchaser selects as his domicilium citandi et executandi for all purposes in terms hereof, the address opposite.
  16. The above terms and conditions constitute the entire contract between the auctioneer and the purchaser.
  17. No variation of this contract, novation or consensual cancellation or any waiver of any portion hereof shall be of any force or effect unless reduced to writing and signed by both parties.
  18. No member of staff has any rights whatsoever to make representation on behalf of the Company OR, to bind the company in any way whatsoever, unless such representation is agreed to in writing and signed, by one of the Members of the Close Corporation.
  19. No warranties or representations whatsoever shall be of any force or effect or binding on the auctioneer unless given in writing and signed by a member of the Close Corporation.
  20. All goods sold are specifically sold without any warranties whatsoever.
  21. Each term and condition contained herein is severable.
  22. In the event that any term hereof is found by a Court of Competent jurisdiction to the unenforceable for any reason, the remainder of the terms shall continue to apply and be of full force and effect.


1.    If there is a dispute between two or more bidders, the lot maybe put up for sale again or the auctioneer may declare the purchaser. The decision of the auctioneer is final.
2.    If the bidder is successful, an automatically generated system email notification will be sent to him/her confirming that he/she is the highest bidder. This is not final confirmation. The sale of the lot is only confirmed on email from The Auctioneer.
3.    Withdrawal of Bids. Any bidder wishing to withdraw his/her bid may do so before the fall of the hammer, which is once a particular lot closes on an online auction. Withdrawal of a bid must be done in writing and a bid will only be deemed withdrawn upon receipt of written confirmation by the Auctioneer.
4.    The Auctioneer accepts no responsibility for any interruption in internet connection resulting in the bidder being disconnected from the live auction, be it the bidder's or Auctioneer's internet connection interruption for any reason.
5.    While the auction is scheduled to close at a predetermined time. Lots have their own specific closing times. It is the bidders responsibility to make him/herself aware of these times. There are 2 online auction functions that effect the closing time of lots
a.    Sniping - “extended bidding” process to close all of our auctions. If a bidder places a bid within 2 minutes of the auction close, the auction will continue for any lots that have multiple bids until there are no bids placed on any lots in the auction in a 2 minute time frame. You MUST place a bid on the lot in order to bid in extended bidding. Any lots with only one bid will close at the beginning of extended bidding.
b.    Staggering: At the scheduled closing date and time of a sale, lots will begin to close one lot at a time with one (1) minute between each lot closing. For example lot 100 will close 100 minutes after the start of the auction close.
6.    The Auctioneer reserves the right to deny any person for any reason permission or access to bid online.
7.    The Auctioneer reserves the right to extend bidding should there be an issue with the system.
